Thanks for your interest in the TrophySmack Creator Network. We’re excited about creators who make high-quality content, follow the rules, and grow with us. We aim for transparent, fair, and creative partnerships.
The TrophySmack Creator Network focuses on content that actually moves the needle — videos, reviews, and creator moments that drive awareness and sales. We only approve affiliate partners that create content that aligns with our products and the audiences we serve. We do not work with or pay commissions to affiliates that are coupon sites or use alternative SEM and other non-approved tactics to drive commissions. Any SEM campaigns must be provided to and approved by TrophySmack before deploying or affiliate risks removal from the program.

TrophySmack Creator Network Terms and Conditions
Effective Date: October 20, 2025
These Terms & Conditions (“Terms”) govern participation in the TrophySmack Creator Network (the “Program”) operated by TrophySmack, Inc. (“TrophySmack”, “we”, “us”, or “our”). By applying to or participating in the Program you (“Creator”, “Affiliate”, or “you”) agree to these Terms in full. If you do not agree, do not apply or participate.
1. Program Eligibility & Application
1.1. Approval Right. TrophySmack reserves the right to accept or reject any application in its sole discretion. Acceptance creates a non-exclusive, revocable relationship governed by these Terms.
1.2. Who We Want. The Program is intended for creators who produce original, engaging content on platforms such as TikTok, Instagram, YouTube, Twitch, podcasts, or content websites. Preference will be given to creators aligned with TrophySmack’s brand (sports, fantasy, entertainment, fandom).
1.3. No Guarantee. Acceptance is not guaranteed, and we may limit the number of Creators. We may also invite Creators for specific campaigns or product launches.
1.4. Representative Accuracy. You must provide accurate, current information (handles, contact info, payment info) in your application. Providing false information is grounds for immediate removal.
2. Program Structure & Platform Attribution
2.1. UpPromote First. The Program’s primary integration is through UpPromote. For creators using UpPromote, commissions and tracking will be handled by UpPromote’s systems according to their attribution rules.
2.2. Off-Platform Creators. Creators on platforms other than UpPromote may be onboarded via bespoke arrangements (special links, coupon codes, TikTok Shop or similar affiliate management platforms, or direct campaign payments). Such arrangements will be communicated in writing per campaign.
2.3. Tracking & Attribution Models. For off-platform links (e.g., UpPromote or our own affiliate links/coupons), TrophySmack uses the following general rules unless otherwise specified for a campaign:
+ Last-click/last-link wins: If a referral clicks multiple creators’ links, the last affiliate link used before purchase is typically credited. (TikTok Shop attribution may differ per TikTok’s rules.)
+ Cookie Attribution: TrophySmack sets a cookie at the time of click. See Section 5 for cookie details.
3. Links, Codes & Public Distribution Rules
3.1. Unique Links/Codes. For approved off-platform creators, a unique affiliate referral link and/or coupon code may be assigned. That link/code is for the Creator’s use only.
3.2. No Public Coupon Aggregation. Affiliates whose coupon codes or links are posted on public coupon or deal aggregator sites — or otherwise made widely and freely available to the general public — will be removed and forfeit commissions for transactions resulting from those public placements. This is considered program abuse.
3.3. Embedding Links. When sharing affiliate links in posts, you must use the full URL or approved share buttons that include your referral parameters. Truncated or redirected links that strip tracking parameters may not be tracked and will not earn commissions.
3.4. Mandatory Use of Provided Tools. If we provide sharing shortcuts, embed codes, or official trackable content, you must use those when asked. Failure to use approved tracking may result in non-payment.
4. Cookies, Tracking & Technical Requirements
4.1. Cookie Tracking. For off-platform links, TrophySmack uses cookies to track referrals. The cookie period is 180 days from the time of the referral click unless otherwise specified for a campaign. If the referred user purchases within the 180-day window and has not been reassigned to another Creator via a later affiliate click, the sale is credited to the original Creator.
4.2. Cookie Limitations. If a user blocks cookies, clears cookies, or uses privacy tools that prevent tracking, TrophySmack may be unable to track that referral and will not pay a commission for associated purchases.
4.3. Cross-Device & Platform Tracking. If a user clicks on your link on device A and later purchases on device B without clicking your link on that second device, attribution may fail. We are not liable for cross-device tracking failures.
4.4. Tracking Best Practices. Always use your complete referral URL or our share tools, avoid editing tracking parameters, and do not instruct followers to remove tracking query strings.
4.5. Cookies vs. Platform Attribution. For platform-native integrations (e.g., TikTok Shop), platform attribution rules supersede our cookie rules where applicable. TikTok may use its own view-through, click-through, and session attribution models.
5. Content & Brand Guidelines
5.1. Accuracy & Honesty. All Creator content must be accurate, not misleading, and must not make claims about product efficacy or promises that TrophySmack does not support.
5.2. FTC & Platform Disclosures. Creators must comply with all applicable laws and platform rules, including FTC guidance on influencer disclosures. Use clear disclosures such as #ad, #sponsored, or #TrophySmackPartner where required.
5.3. Prohibited Content. Content that is illegal, discriminatory, sexually explicit, violent, or otherwise harmful is prohibited. Content that damages TrophySmack’s reputation or violates platform rules may result in removal from the Program.
5.4. Right to Request Changes. TrophySmack reserves the right to request post edits or removal of content that violates brand safety, accuracy, or policy standards. Creators must comply within a reasonable period.
6. Intellectual Property & Content Usage
6.1. License to Use Creator Content. By participating, you grant TrophySmack a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, repost, reproduce, modify, and display your approved content across TrophySmack marketing channels, ads, and social platforms. We will aim to provide credit when feasible.
6.2. Use of Trademark & Logo. Use of TrophySmack trademarks, logos, or brand assets must follow our brand guidelines and is allowed only with prior approval or through our provided asset library.
7. Suspension, Removal & Program Abuse
7.1. Immediate Removal. TrophySmack may suspend or remove any Creator from the Program immediately for: (a) fraud or abuse, (b) manipulation of tracking, (c) promotion on deal/coupon aggregator sites, (d) misrepresentation of TrophySmack, or (e) content that violates these Terms.
7.2. Inactive Accounts. Accounts inactive for 90 consecutive days may be removed.
7.3. Appeal Process. If removed, you may email affiliates@trophysmack.com to request review. Reinstatement is at TrophySmack’s sole discretion.
8. Confidentiality & Privacy
8.1. Confidential Information. Any confidential operational details we share (campaign plans, negotiated rates, unpublished tracking methods) must not be disclosed without written permission.
8.2. Data & Privacy. TrophySmack will process personal data according to our Privacy Policy. Creators must not collect or store customer payment information and must comply with applicable privacy laws.
9. Relationship, Liability & Indemnity
9.1. Independent Contractors. Creators are independent contractors; nothing in these Terms creates an employer/employee, agency, or joint venture relationship.
9.2. No Warranty. TrophySmack provides the Program “as is” and does not guarantee tracking, uptime, or commission amounts beyond what is recorded.
9.3. Limitation of Liability. TrophySmack is not liable for indirect, incidental, special, or consequential damages arising from participation.
9.4. Indemnity. You agree to indemnify and hold TrophySmack harmless from claims, liabilities, losses, or expenses arising out of your content, failure to disclose, or breach of these Terms.
10. Taxes & Reporting
10.1. Taxes. Creators are responsible for all taxes related to their earnings. TrophySmack may collect tax information where required and report payments to tax authorities when legally obligated.
10.2. US Tax Forms. For US Creators, TrophySmack may request W-9 information for payments exceeding IRS thresholds.
11. Changes to Terms & Program
11.1. Right to Modify. TrophySmack may modify these Terms or the Program at any time. We will post updates or notify active Creators via email. Continued participation after changes signifies acceptance.
11.2. Legacy Program Closure. As of October 15, the legacy coupon/link structure will be sunset. Any legacy referrals or arrangements will be subject to the rules above unless we specify grandfathered terms in writing.
12. Dispute Resolution & Governing Law
12.1. Governing Law. These Terms are governed by the laws of the state of California (excluding conflict-of-law rules).
12.2. Dispute Process. For disputes, email affiliates@trophysmack.com first. If unresolved, parties may seek resolution in a court of competent jurisdiction in Orange County, California.
